Sub: Clearance of imported metal Scraps – Procedure
regarding.
1. Attention of all importers, Custom House Agents (CHA), Steamer/Shipping Agents, Shipping Lines, Carriers, Freight Forwarders, Custodian of Imported goods, officers of Customs, Members of Trade and all other others concerned is drawn to Circular No. 56/2004 Cus, dated 18.10.04, which is self explanatory (copy enclosed).
2. As specified in the above mentioned Circular, metal scraps falling in category I i.e. scrap which has already landed in India and that which has left its port of origin on or before 25.10.04 would be cleared after 100% physical examination. As per para 4(i) of the Circular, manufacturer importers may file a request in writing, with the Commissioner of Customs (Import), J.N.C.H., for conducting 100% physical examination of goods by Central Excise Officers at the factory premises of the importers. The request should contain the following information, apart from other details:
a) Name of the Importer
b) Address of the factory
c) R.C. No.
d) Name of the Jurisdictional range office
e) Name of the Jurisdictional division office
Such requests will be considered on a case to case basis and subject to the conditions specified in para 4(i) of the circular ibid.
3. As per para
4(i), the facility of examination at the importers
premises is not available to traders.
The 100% physical examination of all such consignments imported by
traders shall be done only at the specific notified areas for handling, storing
or examination of Metal Scrap. The
