STANDING ORDER NO. 14 /2013

Sub : Export of notified commodities – re-iteration of directions of S.O. No. 30/2008 dated 11.07.2008 – mandatory production of EIA Certificate – Reg.

01. Attention of all the officers is drawn to the Standing Order No. 30/2008 dated 11.07.2008 issued from JNCH w.r.t. the subject captioned above.

02. The Export Inspection Agency under Ministry of Commerce and Industry conveyed that the following commodities have been notified under Section 7 of the Export (Quality Control and Inspection) Act, 1963, under the respective Standing Order of EIA cited against;

03. As per the schemes of the their notifications, export of these commodities is prohibited in the course of International Trade unless it conforms to the standards applicable to the commodity under export and is accompanied by a Certificate stating that the processing establishment is approved and monitored by the Export Inspection Agencies established under Section 7 of the Export (Quality Control and Inspection) Act, 1963.

In view of the above, export of above mentioned notified commodities is permitted only if the products are manufactured in establishments approved and monitored by the Export Inspection Agencies and such consignments are covered / accompanied by a Certificate of Inspection / Certificate of Export. The list of processing establishments approved by the EIAs, related to GOI Notifications and Orders and other details relating to the standards applicable are already available as public information on the Export Inspection Council of India website i.e. www.eicindia.gov.in

05. However, notwithstanding the aforesaid directions of Standing Order No. 30/2008 dated 11.07.2008, it appears that the same are not being followed strictly by the Officers of Central Excise viz. Inspectors and Superintendents in respect of factory stuffing as has been brought to our notice by the Export Inspection Agency (EIA), Mumbai and they have expressed their concerns regarding milk products being exported without approval from the Competent Authority i.e. EIA and without paying the necessary fee resulting in loss of revenue to the Government and also, regarding possibility of compromising on the quality and standards of the milk products. Such lapses may bring a bad name to the country in the international trade which requires certain standards and quality to be maintained in respect of the aforesaid notified goods. Therefore, the concerned Central Excise Officers viz. Inspectors of Central Excise, Superintendent of Central Excise posted for examination and stuffing supervision in factory/warehouse premises must verify the Pre-Shipment Inspection Certificate issued by the Export Inspection Agency under the Export (Quality Control & Inspection) Act, 1963. Also, the Officers of Customs viz. Inspectors (Examiners/Preventive Officers), Superintendents of Customs/ Appraising Officers posted at the Export Docks/Sheds for verification of documents and granting Let Export Order (LEO) of factory stuffed cargos, are directed to strictly ensure that the exporters have submitted the Inspection Certificate issued by EIA w.r.t. above mentioned notified goods and the products are manufactured in the establishments approved and monitored by EIAs.

06. Similarly, keeping in view the concerns of Export Inspection Agencies, all the Officers of Customs viz. Inspectors (Examiners/Preventive Officers), Superintendents of Customs / Appraising Officers posted at docks/sheds for examination, granting Let Export Order (LEO) of export goods directly brought to the docks/sheds for export, are also directed to strictly ensure that the exporters have submitted the Inspection Certificate issued by Export Inspection Agency(EIA) for the above mentioned notified commodities and the products are manufactured in the establishments approved and monitored by EIAs.

07. In view of the above, it is hereby directed that the instructions/directions in the Standing Order No. 30/2008 dated 11.07.2008 re-iterated in this new Standing Order, must be followed strictly in letter and spirit by the concerned officers.
